SHIPPING AND RETURNS
The owner of birkenthal.com (hereinafter the Online Shop) is BIRKENTHAL OÜ (registry code 14863510), located in Tallinn.
The cost of shipping the goods is borne by the buyer and the corresponding price information is displayed next to the shipping method.
Domestic shipments generally arrive at the destination specified by the buyer within 5 business days starting from the entry into force of the contract of sale. Delivery outside Estonia is within 14 calendar days.
In exceptional cases, the delivery may take up to 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Shop within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered merchandise may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods as permitted for physical testing of the goods.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods, or if they show signs of use or wear, the Online Shop has the right to reduce the refundable amount in proportion to the value of the goods.
To return the item, you must submit a withdrawal form, which can be found at: return form and send it to email@example.com no later than 14 days after receiving the item.
The cost of returning the goods shall be borne by the buyer unless the reason for the return is the fact that the item to be returned does not correspond to the ordered one (eg wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or provide proof that he has delivered the goods to the carrier within the said period.
Upon receipt of the returned goods, the Online Shop shall refund the Purchaser any fees received from the Purchaser under the Agreement immediately, but not later than 14 days after receipt of the application for withdrawal.
The Online Shop may refuse to provide a refund until the item that is the subject of the contract has been returned or the buyer has provided proof of return, whichever is earlier.
If the buyer has explicitly opted for a method of delivery other than the cheapest standard delivery method offered by the Online Shop, the Online Shop does not have to reimburse the consumer for any cost exceeding the standard delivery method.
The online shop has the right to withdraw from the sale and reclaim the goods from the buyer if the price of the goods in the online shop is mistakenly marked below the market price of the goods.
Right to file a claim
The Online Shop shall be liable for any lack of conformity or defect in the goods sold to the Purchaser, which already existed at the time of delivery of the item, and which occurs within two years of delivery of the goods to the Purchaser. Within the first six months of delivery of the item to the buyer, the defect is presumed to have existed at the time of delivery. It is the Online Shop’s responsibility to rebut this assumption.
The purchaser has the right to contact the Online Shop within two months at the latest by sending an e-mail to firstname.lastname@example.org.
The Online Shop is not responsible for any defects that occur after delivery of the goods to the buyer.
If any item purchased from the Online Shop has defects for which the Online Shop is responsible, the Online Shop will repair or replace the defective item. If the goods cannot be repaired or replaced, the Online Shop will refund the Purchaser all the fees associated with the contract of sale.
The Online Shop responds to a consumer complaint in writing or in a format that can be reproduced in writing within 14 days.

Shipping and Returns
If the Buyer and the Online Shop fail to resolve the dispute by agreement, the Buyer may refer the matter to the Consumer Disputes Committee. The procedural conditions can be found and the application can be made here. The Consumer Disputes Committee is competent to resolve any disputes arising from the contract between the buyer and the Online Shop. The Commission’s review of the buyer’s complaint is free of charge.
